THE OBJECTS OF THE CHARITY ARE: A) TO PRESERVE, PROTECT, IMPROVE AND ENHANCE THE PHYSICAL, MENTAL AND EMOTIONAL HEALTH OF THE PREFERRED BENEFICIARIES AND OTHER PERSONS RESIDING IN THE COMMUNITIES IN WHICH THEY LIVE INCLUDING BUT NOT LIMITED TO THE PROVISION OF GRANTS AND THE PROVISION OF COMMUNITY FACILITIES AND RESOURCES FOR VOLUNTARY ORGANISATIONS; B) THE RELIEF OF THOSE IN NEED, HARDSHIP OR DISTRESS IN PARTICULAR BUT WITHOUT LIMITATION FOR PREFERRED BENEFICIARIES, INCLUDING BUT NOT LIMITED TO THE PROVISION OF ACCOMMODATION SUCH AS CONVALESCENT AND RETIREMENT HOMES AND THE PAYMENT OF COSTS TOWARDS STUDY FOR A PROFESSION, TRADE OR CALLING; AND C) THE ADVANCEMENT OF HEALTH BY FOSTERING COLLABORATION AND COOPERATION BETWEEN BRITAIN AND FRANCE IN THE MEDICAL AND PARA-MEDICAL FIELDS, IN PARTICULAR BUT NOT EXCLUSIVELY BY MAKING GRANTS TO SUPPORT APPLIED RESEARCH INTO HUMAN HEALTH, HOSPITAL CARE (WITH A PREFERENCE FOR SUPPORTING HOSPITAL CARE FOR PREFERRED BENEFICIARIES) OR SUCH OTHER MEANS AS THE TRUSTEES CONSIDER APPROPRIATE, INCLUDING BUT NOT LIMITED TO, MEDICAL RESEARCH, MEDICAL EDUCATION AND THE FOSTERING OF ANGLO-FRENCH CO-OPERATION IN THE MEDICAL FIELD; PREFERRED BENEFICIARIES SHALL MEAN PERSONS RESIDENT IN FRANCE WHO ARE BRITISH AND THEIR IMMEDIATE CLOSE RELATIVES AND OTHER PERSONS RESIDENT IN FRANCE WITH BRITISH CONNECTIONS OR ASSOCIATIONS INCLUDING (BUT WITHOUT LIMITATION) PERSONS WHO HAVE IN THE PAST BEEN RESIDENT IN THE UNITED KINGDOM. VOLUNTARY ORGANISATIONS SHALL MEAN INDEPENDENT ORGANISATIONS, WHICH ARE ESTABLISHED FOR PURPOSES THAT ADD VALUE TO THE COMMUNITY AS A WHOLE, OR A SIGNIFICANT SECTION OF THE COMMUNITY, AND WHICH ARE NOT PERMITTED BY THEIR CONSTITUTION TO MAKE A PROFIT FOR PRIVATE DISTRIBUTION. VOLUNTARY ORGANISATIONS DO NOT INCLUDE LOCAL GOVERNMENT OR OTHER STATUTORY AUTHORITIES. IN THESE ARTICLES ‘PUBLIC BENEFIT’ MEANS PUBLIC BENEFIT IN ACCORDANCE WITH THE LAW OF ENGLAND AND WALES PROVIDED THAT WHEN INTERPRETING THESE ARTICLES AND IN PARTICULAR THE OBJECTS, AND GIVEN THAT THE CHARITABLE ACTIVITY IS MATERIALLY CARRIED OUT IN FRANCE, THE TRUSTEES WILL BE MINDFUL OF THE REQUIREMENTS OF RELEVANT FRENCH LAW WITH REGARDS TO THE RECOGNITION OF THE CHARITY OR ITS ASSOCIATED FRENCH ENTITIES AS BEING “D’UTILITÉ PUBLIQUE” THAT IS, IN THE PUBLIC INTEREST. FOR THE AVOIDANCE OF DOUBT, THE LAW GOVERNING THE CHARITY IS THE LAW OF ENGLAND AND WALES.
