Charitable objects

FOR THE BENEFIT OF THE INHABITANTS OF THE PARISH OF WARHAM IN THE COUNTY OF NORFOLK AND IN PARTICULAR (1) FOR SO LONG AS THE ENCLOSURE ADJACENT TO CHAPEL STREET, WARHAM KNOWN AS THE WARHAM VILLAGE GREEN IS AVAILABLE TO THE PEOPLE OF WARHAM AS A PUBLIC OPEN SPACE TO APPLY THE INCOME OF THE TRUST FUND UP TO A LIMIT OF ú500 A YEAR TO DEFRAY THE EXPENSE OF WARHAM PARISH COUNCIL ENGAGING A CONTRACTOR TO CARRY OUT PROPERLY THE LESSEES' OBLIGATIONS NAMELY "TO KEEP THE GRASS ON THE PROPERTY PROPERLY MOWN ROLLED AND FREE FROM WEEDS AND DISEASE AND ENSURE ALL TREES SHRUBS ARE KEPT PROPERLY LOPPED CUT AND PRUNED" UNDER PARAGRAPH (5) OF CLAUSE 2 OF A LEASE DATED 31ST JANUARY 1991 AND MADE BETWEEN SIMON BIRCH, THOMAS COCKAYNE HARVEY AND ANTHONY NICHOLAS GEORGE DUCKWORTH-CHAD OF THE ONE PART AND WARHAM PARISH COUNCIL OF THE OTHER PART FOR 21 YEARS FROM 11TH OCTOBER 1989 AND ANY RENEWAL OF THAT LEASE RELATING TO THE SAID ENCLOSURE PROVIDED THAT NO PAYMENT TO WARHAM PARISH COUNCIL FOR THIS PURPOSE SHALL BE MADE UNTIL WARHAM PARISH COUNCIL HAS CARRIED OUT ALL THE LESSEES' OTHER OBLIGATIONS UNDER THE SAID LEASE INCLUDING PROPER MAINTENANCE OF SEATS FENCES AND WATER BUTTS AND THE TRUSTEES HAVE RECEIVED WRITTEN CONFIRMATION FROM WARHAM PARISH COUNCIL THAT THIS HAS BEEN DONE AND UNTIL THE TRUSTEES HAVE RECEIVED COPIES OF THE CONTRACTORS' INVOICES IN RESPECT OF THE EXPENSES TO BE DEFRAYED; (2) TO PAY THE REST OF THE INCOME IF ANY (AND THE WHOLE OF THE INCOME IF THE SAID ENCLOSURE ADJACENT TO CHAPEL STREET WARHAM CEASES TO BE AVAILABLE TO THE VILLAGE AS THE WARHAM VILLAGE GREEN) AT THE TRUSTEES' DISCRETION TO WARHAM ALL SAINTS AND ST. MARY'S PAROCHIAL CHURCH COUNCIL TO ASSIST IN PAYING FOR THE MAINTENANCE OF THE BUILDING KNOWN AS WARHAM READING ROOM FOR SO LONG AS THE SAID READING ROOM IS MADE AVAILABLE TO THE PEOPLE OF WARHAM FOR PURPOSES WHICH ARE CHARITABLE IN LAW; (3) SUBJECT TO THE FOREGOING FOR SUCH OTHER CHARITABLE PURPOSES AS THE TRUSTEES IN THEIR ABSOLUTE DISCRETION THINK FIT....
