Charitable objects
(1)THE OBJECTS OF THE CHARITY ARE: (A)THE PROVISION OF HOUSING ACCOMMODATION TO PEOPLE WHO ARE IN NEED, HARDSHIP OR DISTRESS AND WHO THE TRUSTEES HAVE IDENTIFIED AS HAVING A NEED FOR ACCOMMODATION IN THE AREA OF BENEFIT, INCLUDING BUT NOT LIMITED TO THEM HAVING A CONNECTION TO THE AREA OF BENEFIT OR A NEED TO RESIDE IN THE AREA OF BENEFIT FOR THEIR EDUCATION OR EMPLOYMENT; (B)SUCH CHARITABLE PURPOSES FOR THE BENEFIT OF THE RESIDENTS AS THE TRUSTEES DECIDE; (C)THE RELIEF OF BENEFICIARIES WHO ARE IN NEED, HARDSHIP OR DISTRESS; (D)THE PROVISION OF ITEMS, SERVICES AND FACILITIES FOR NURSERIES,PRE-SCHOOLS, SCHOOLS, COLLEGES OR OTHER RECOGNISED PLACES OF EDUCATION, LEARNING OR TRAINING THAT ARE OPERATING WITHIN OR PROVIDING SERVICES WITHIN THE AREA OF BENEFIT. (2)FOR THE PURPOSES OF THIS CLAUSE 3 (OBJECTS): (A)“BENEFICIARIES” MEANS IN THE FOLLOWING ORDER OF PRIORITY: (I)PERSONS WITH A CONNECTION TO OR LIVING IN THE PARISH OF BURNESTON, INCLUDING THE VILLAGES OF EXELBY, THEAKSTON, BURNESTON, CARTHORPE, CAMP HILL, SWAINBY WITH ALLERTHORPE, LONDONDERRY, GATENBY AND LEEMING; (II) PERSONS WITH A CONNECTION TO OR LIVING WITHIN A 5-MILE RADIUS OF ANY OF THE VILLAGES LISTED IN CLAUSE 3(2)(A)(I). (B)“AREA OF BENEFIT” MEANS THE PARISH OF BURNESTON INCLUDING THE VILLAGES LISTED IN CLAUSE 3(2)(A)(I) AND THE AREA WITHIN A 5-MILE RADIUS OF ANY OF THE VILLAGES LISTED IN CLAUSE 3(2)(A)(I). IN EXCEPTIONAL CIRCUMSTANCES, THE TRUSTEESHAVE DISCRETION ACTING IN THE CHARITY’S BEST INTERESTS TO APPOINT A RESIDENT WHO DOES NOT HAVE A CONNECTION TO THE AREA OF BENEFIT, BUT IS OTHERWISE QUALIFIED. THE TRUSTEES MUST RECORD IN THE MINUTES OF THEIR MEETINGS THE NATURE OF THE EXCEPTIONAL CIRCUMSTANCES JUSTIFYING THE APPOINTMENT. (C)FOR THE PURPOSES OF CLAUSE 3(2)(A) AND IDENTIFYING QUALIFYING BENEFICIARIES THE TRUSTEES HAVE DISCRETION ACTING IN THE CHARITY’S BEST INTERESTS TO DETERMINE WHETHER A PERSON HAS A SUITABLE CONNECTION TO THE AREA OF BENEFIT. (D)“RESIDENTS” MEANS PEOPLE WHO LIVE IN THE HOMES FROM TIME TO TIME AND “RESIDENT” MEANS ONE OF THE RESIDENTS. (E)“HOMES” MEANS THE ALMSHOUSES OF THE CHARITY “HOME” MEANS ONE OF THE HOMES
